Is it legal for employers to order and obtain criminal record search information?

 

YES.

 

A criminal record search may be ordered on an existing or prospective employee when a consent form is signed. In the case of a prospective employee, a criminal record search may be conducted only when a conditional offer of employment is made and where a background check is initiated. An employer MAY pose the question in writing on the application form or verbally as to whether they have a 'criminal record' in the following manner: "Have you ever been convicted of a crime for which you have not been pardoned?"

 

Isn’t that a form of discrimination?

 

Discrimination based on criminal record is not a Human Rights violation in MOST provinces. UNLESS the person has received an official pardon for a crime the employer may discriminate.

 

The greatest MISCONCEPTION is that after a lengthy lapse of time without criminal charges being laid, a criminal record is automatically expunged. This is not the case. Without a pardon, a criminal charge will follow throughout one’s working career.
